Terms of Service

Welcome to Viboo ("the Platform", "we", "us", "our"). By accessing or using viboo.fun, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

1. Eligibility

You must be at least 18 years of age to create an account, upload content, or purchase content on Viboo. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. We reserve the right to request age verification at any time and to suspend accounts where eligibility cannot be confirmed.

2. Account Responsibility

You are solely responsible for maintaining the security of your account credentials, wallet keys, and any activity that occurs under your account. Viboo is not responsible for unauthorized access resulting from compromised credentials. You may delete your account at any time through the Settings page, which permanently removes all associated data.

3. Content Ownership and License

You retain full ownership of all content you upload to Viboo. By posting content, you grant Viboo a non-exclusive, worldwide, royalty-free license to store, display, distribute, process, and transmit your content solely as necessary to operate and provide the Platform. This license terminates when you delete the content or your account.

You represent and warrant that you own or have the necessary rights to all content you upload, and that your content does not infringe on any third party's intellectual property rights, privacy rights, or other legal rights.

4. Prohibited Content

You may not upload, post, or distribute content that:

• Depicts, exploits, or involves minors in any context whatsoever
• Contains non-consensual intimate imagery or "revenge" content
• Promotes or depicts illegal activity, including but not limited to drug trafficking, weapons sales, or fraud
• Contains threats, harassment, doxxing, or incitement to violence
• Infringes upon copyrights, trademarks, or other intellectual property rights
• Contains malware, phishing links, or deceptive content designed to defraud users
• Violates any applicable local, state, national, or international law

Violation of these guidelines will result in immediate content removal and may result in permanent account termination and referral to law enforcement where appropriate.

5. Sensitive Content

Creators may mark content as sensitive/18+. Sensitive content is hidden by default and only visible to users who have opted in via their account settings. Creators are responsible for accurately marking their content. Failure to properly label sensitive content may result in content removal or account action.

6. Payment Terms

All payments on Viboo are processed in USDC (a US dollar-denominated stablecoin) on the Solana blockchain. The fee structure is as follows:

• Creator earnings: 88% of each transaction
• Platform fee: 12% of each transaction

Payments are settled atomically on-chain via split transactions. Creators receive their share instantly at the time of purchase. Viboo does not custody creator funds at any point in the transaction flow.

All blockchain transactions are final and irreversible. Viboo cannot reverse, refund, or modify any on-chain transaction. Users are responsible for ensuring they have sufficient balance before purchasing content. By making a purchase, you acknowledge and accept the non-refundable nature of blockchain transactions.

7. Expiring and Limited Content

Content marked as "Flash" will be permanently deleted after its expiration period. Content marked as "Drop" is limited to a fixed number of unlocks. These restrictions are enforced automatically and are irreversible. Purchased access to expired content will no longer be available after expiration.

8. DMCA and Copyright Claims

Viboo respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe content on Viboo infringes your copyright, you may submit a takedown notice to dmca@viboo.fun including:

• Identification of the copyrighted work
• Identification of the infringing material and its location on the Platform
• Your contact information
• A statement of good faith belief that the use is unauthorized
• A statement under penalty of perjury that the information is accurate
• Your physical or electronic signature

We will investigate and respond to valid DMCA notices promptly, including removing infringing content and notifying the uploader. Repeat infringers will have their accounts terminated.

9. Account Termination

We reserve the right to suspend or permanently terminate any account that violates these Terms, at our sole discretion and without prior notice. Upon termination:

• All content and data associated with the account will be permanently deleted
• Any pending or future earnings will be forfeited
• The user may not create a new account without our express permission

Users may voluntarily delete their account at any time through the Settings page. Voluntary deletion permanently removes all content, profile data, and transaction history.

10. Limitation of Liability

Viboo is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, Viboo disclaims all warranties including merchantability, fitness for a particular purpose, and non-infringement.

In no event shall Viboo, its operators, affiliates, or service providers be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of or inability to use the Platform
• Loss of funds due to blockchain transactions, wallet security issues, or smart contract interactions
• Content disputes between users
• Unauthorized access to your account or wallet
• Service interruptions, downtime, or data loss
• Actions of third-party services (blockchain networks, wallet providers, etc.)

11. Indemnification

You agree to indemnify and hold harmless Viboo and its operators from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your content, or your violation of these Terms.

12. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via the Platform. Continued use of Viboo after changes are posted constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration.
